Charges have been  dropped  in the case of a  Smyrna woman who was  accused of pointing a loaded handgun at a former tenant.

In August,   troopers were dispatched to the 400 block of South  Carter Road. It was learned that the 44-year-old male had gone to turn over his keys.  A disagreement ensued between the victim and 44-year-old, Melanie Ballard.  Troopers said Ballard pointed a handgun at the man.

Ballard was taken into custody without incident. Taken from the scene was a loaded Glock 22 .40 caliber handgun.  Ballard was charged with the following:

  • Possession of a Firearm During the Commission of a Felony
  • Aggravated Menacing

Ballard, a real estate agent, was arraigned before the Justice of the Peace Court 2 and released on $25,000  unsecured bond.

The Kent County Court of Common Pleas issued a Noelle Prosequi, a term that means no prosecution will occur from  the Attorney General’s Office.
