State offers details on Wayback restaurant inspection

The closing of the Wayback Burger location on Ogletown came after a visit  by the  Delaware Public Health Office of Food Protection  in response to  overflowing trash in the dumpster.

According to the statement issued by Andrea Wojcik, Chief of Community Relations for the Division of Public Health,  inspectors  found several violations including a leaking sink, equipment not holding food at appropriately  cold temperatures, and no food storage in the freezer.  Wayback serves ice cream products.

A second inspection  on  Feb. 16,  found that the deficiencies had not been corrected and a sink used for hand washing was not working. 

Inspectors closed the restaurant for  Unsanitary Conditions,  which if not corrected are likely to cause foodborne illnesses.  A Cease and Desist letter  was also issued.

No fines were assessed.

“Whether fines may be assessed in the future vary by circumstances.  Jake’s ability to re-open at this location is dependent upon making repairs to the issues which lead to the closure, and passing re-inspection.”

Anyone who is concerned they may have contracted a foodborne illness from any food establishment is asked to contact the Office of Food Protection (OFP) Consumer Complaint Hotline at 302-744-4736 as soon as possible so staff can visit the food establishment and enlist additional DPH staff as needed in identifying the source of your illness.  

When a complaint is received it is investigated, on a prioritized basis, as soon as possible. Complaints are investigated by  field staff by visiting the establishment, the release noted.
