A company that controls patents on wireless technology plans to go to U.S. District Court in Delaware with claims against Apple and Research in Motion (Blackberry).
After an unfavorable ruling with the International Trade Commission in the case, the company announced in its blog that it will take its claim to federal court.
It had filed an action in Delaware federal court last year, while it made its case with the International Trade Commission.
Unwired Planet produces no equipment, but instead gains patents that it uses in legal actions against companies it claims are violating those patents. The company has its roots in the Silicon Valley, but has divested other businesses and moved its headquarters to Nevada. Companies in this arena are sometimes dubbed “patent trolls.”
Earlier this year, the company employed a blimp to fly over the Silicon Valley and highlight its new brand.
