A new distillery is closer to becoming a reality after the Delaware General Assembly passed legislation making  a standalone  operation legal in the state.

Legacy Distilling plans to operate in Smyrna, according to its Facebook page. 

Legacy   will participate in this year’s Delaware Wine & Beer Festival on  October 21. No samples are likely at that time, according to the  Facebook page.

It would be the first legal distillery in many years for Delaware.

Distilleries have popping up around the country  following the success of craft brewers, such as Dogfish Head, based in Milton.

Dogfish Head has been producing small quantities of rum and other beverages at its brewpub in Rehoboth Beach under  a law that allows such activities.
